1. PREAMBLE AND ACCEPTANCE
Welcome to planyourpackage.com (hereinafter referred to as the "Platform," "Website," "We," "Us," or "Our"). This Website is owned and operated by PlanYourPackage, a company incorporated under the laws of India.
By accessing, browsing, or utilizing any services provided on this Platform, you (hereinafter referred to as the "User," "Traveler," "Client," or "You") acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute an electronic record in accordance with the Information Technology Act, 2000 and rules thereunder, as applicable and the amended provisions pertaining to electronic records in various statutes. This electronic record is generated by a computer system and does not require any physical or digital signatures.
2. ELIGIBILITY AND CAPACITY TO CONTRACT
2.1. Age Requirement: The Services are available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, including minors (persons under the age of 18 years), un-discharged insolvents, etc., are not eligible to use the Website.
2.2. Representation: If you are booking on behalf of a minor, you represent and warrant that you are the parent or legal guardian of such minor and that you accept these Terms on the minor's behalf. You explicitly agree to indemnify the Platform against any claims arising from the minor's use of the services.
3. SCOPE OF SERVICE AND INTERMEDIARY STATUS
3.1. Role as Aggregator: planyourpackage.com acts solely as an aggregator and booking agent. We facilitate connections between Users and third-party service providers, including but not limited to hotels, camp operators, rafting agencies, transport providers, and guides ("Service Providers").
3.2. No Principal-Agent Relationship: We are not the principal provider of these services. The contract for the actual provision of services is directly between You and the Service Provider. We do not control the operations, safety standards, or personnel of these Service Providers.
3.3. Limitation of Control: We are not liable for any acts, omissions, errors, representations, warranties, breaches, or negligence of any Service Providers or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom.
4. BOOKING, PRICING, AND PAYMENTS
4.1. Dynamic Pricing: Prices listed on the Website are dynamic and subject to change based on availability, seasonality, and Service Provider rates. The price is only guaranteed once the booking is confirmed and full payment is processed.
4.2. Taxes: Unless otherwise specified, all prices are exclusive of Goods and Services Tax (GST) and other applicable government levies.
4.3. Payment Processing: All payments are processed through third-party payment gateways. We do not store your banking or credit card details. You agree to abide by the terms and conditions of the respective payment gateway.
4.4. Booking Confirmation: A booking is considered confirmed only upon the issuance of a Booking Confirmation Voucher via email. The deduction of funds from your account does not constitute confirmation until verified by the Platform.
5. ADVENTURE ACTIVITIES: ASSUMPTION OF RISK AND LIABILITY WAIVER
This section is of critical importance for packages involving Rafting, Camping, Trekking, and Bungee Jumping.
5.1. Acknowledgment of Inherent Risk: You acknowledge that participation in adventure activities involves inherent risks that cannot be eliminated without destroying the unique character of the activity. These risks include, but are not limited to:
- Water Hazards: Drowning, near-drowning, hypothermia, water immersion, foot entrapment in rocks, and capsizing of rafts.
- Environmental Hazards: Flash floods, landslides, falling rocks, insect or animal bites, and exposure to extreme weather conditions.
- Physical Exertion: Risks associated with physical strain, heart attacks, or panic attacks during activities.
5.2. Voluntary Participation: By booking an adventure package, you certify that you are physically fit and do not suffer from medical conditions (including heart conditions, high blood pressure, epilepsy, or pregnancy) that would make participation dangerous. You voluntarily assume all risks, known and unknown, associated with these activities.
5.3. Release of Liability: To the fullest extent permitted by Indian law, You hereby release, waive, discharge, and covenant not to sue planyourpackage.com, its officers, agents, and employees from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by You while participating in such activities.
5.4. On-Site Waiver: You may be required to sign a separate, physical liability waiver by the Service Provider at the location (e.g., at the rafting camp). Refusal to sign such a waiver may result in the denial of service without refund.
6. CODE OF CONDUCT AND CAMPING RULES
6.1. Ecological Responsibility: Rishikesh and its surrounding areas are ecologically sensitive. You agree strictly to not litter, pollute the river, or damage local flora.
6.2. Prohibited Substances: The possession or use of illegal drugs and narcotics is strictly prohibited in camps and during activities. Alcohol consumption is restricted to designated areas and times as per the Service Provider's policy. Intoxicated participants will be denied access to rafting/adventure activities without refund.
6.3. Behavior: We reserve the right to terminate your booking immediately without refund if your behavior is deemed threatening, abusive, or dangerous to other guests or staff.
7. FORCE MAJEURE
7.1. Definition: Neither the User nor the Platform shall be liable for any failure to perform obligations under this contract where such failure is a result of "Force Majeure" events. These include, but are not limited to, Acts of God (flood, earthquake, storm, landslide), war, civil unrest, government orders (including bans on rafting by District Administration), pandemics, and strikes.
7.2. Operational Consequence: In the event of a Force Majeure situation:
- If the tour has not commenced, we will offer a Credit Note for the full amount, valid for future travel within 12 months. Cash refunds will be subject to the policies of the individual Service Providers (airlines, hotels).
- If the tour has commenced and is interrupted, we will strive to provide alternative arrangements, but we are not liable for refunds for unutilized services or additional costs incurred for evacuation/return travel.
8. INTELLECTUAL PROPERTY RIGHTS
8.1. All content, trademarks, logos, text, graphics, and software on this Website are the intellectual property of planyourpackage.com or its licensors. You are granted a limited license to access the Website for personal use only. You may not copy, modify, distribute, or create derivative works from our content without express written permission.
9. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless planyourpackage.com, its affiliates, officers, directors, employees, consultants, and agents from any and all third-party claims, liability, damages, and/or costs (including, but not limited to, attorney fees) arising from Your use of the Services, Your violation of these Terms, or Your infringement of any intellectual property or other right of any person or entity.
10. DISPUTE RESOLUTION AND GOVERNING LAW
10.1. Governing Law: These Terms shall be governed by and construed in accordance with the laws of India.
10.2. Jurisdiction: You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts of competent jurisdiction in Dehradun/Rishikesh, Uttarakhand. This jurisdiction clause is valid and binding under the principle of "Party Autonomy" in contracts.
11. AMENDMENTS
We reserve the right to modify these Terms at any time without prior notice. Your continued use of the Website following any changes constitutes your acceptance of the new Terms.
